CJI Dipak Misra breaks silence on dissent by 4 SC judges: 'To criticise, attack, destroy system is easy'

Chief Justice of India Dipak Misra in his address in Supreme Court on Independence Day broke his silence over the dissent of four SC judges. Earlier this year, on 12 January, he was criticised by senior judges in a press conference as they raised questions against judicial functioning under CJI Misra.

After 8 months, he finally hit back at those who accused him of not hearing their concerns. He said, “To criticise, attack and destroy a system is quite easy. What is difficult and challenging is to transform it into a performing one. For this one has to transcend ones' personal ambitions or grievances.”

The four judges - Justices J Chelameswar, Ranjan Gogoi, Madan B Lokur and Kurian Joseph - attacked CJI Misra over the assignment of sensitive cases to junior judges.

Misra said, “Constructive steps need to be taken with a positive mindset. Concrete reforms must be undertaken with rationality, maturity, responsibility & composure. It's necessary to be productive instead of being counter-productive. Then only the institution can go to greater heights.”

In April 2018, more than 60 Rajya Sabha members had signed the notice for initiating impeachment proceedings against Misra. The members presented the notice before Rajya Sabha Chairman Venkaiah Naidu. However, Naidu rejected the impeachment motion stating lack of substantial proof.
